WHEN a Tranmere man faced Wirral magistrates for assault after trouble at Ruperts Club in Birkenhead, Tony Sereni, defending, said it was down to stupidity born out of excess of drink.

Prosecutor Helen Chambers alleged 21-year-old Mark McIntyre rubbed noses with John Thomas on the dance floor and said he was going to get him later.

Outside the club he punched him and bit him to the face. He later told police Thomas made a provocative remark which annoyed him and he decided to attack him.

McIntyre, of Holborn Hill, admitted assault occasioning actual bodily harm. He reacted to verbal abuse after they bumped on the dance floor, said Mr Sereni.

McIntyre was granted a twelve months' conditional discharge but had to pay his victim £150 compensation.
