A WOMAN from Noctorum has been issued with a further eviction order because of her partner's criminal behaviour.

Action was originally taken against Jane Pratt of Ridings Hey by Wirral Anti-Social Behaviour Team, working in partnership with her landlord Wirral Partnership Homes, due to criminal behaviour by her partner.

In February 2007 at Birkenhead County Court, she was issued with an eviction order postponed on condition that she did not permit her partner, Michael Kerr, to enter her home and that she complied with the terms of her tenancy agreement related to criminal activity and anti-social behaviour. The order remains in force until February 13 this year.

Further action was taken against Pratt after her partner, Michael Kerr, was convicted in March 2009 of being in possession of Class A and B drugs - crack cocaine and cannabis - at the property earlier that month.

Kerr was also convicted of possession of cannabis, at the premises in June last year.

Pratt had also been issued with a Fixed Penalty Notice in July 2008 for theft from a shop in Townfield Lane, Oxton, which is close to her home.

An application was made for a warrant of possession of her home. Pratt, 45, subsequently made an application to suspend the warrant and at Birkenhead County Court on October 6 a trial date was listed for January 12.

On that day District Judge Travers issued Pratt with a further eviction order postponed for two years on condition that she does not invite Kerr to her home or permit him to enter the property including the garden and driveway areas.

She is also required to comply with the terms of her tenancy agreement related to criminal activity and anti-social behaviour.

Pratt agreed in court to take any steps that may be necessary to prevent Kerr from entering the property, such as changing the locks, for example, or calling the police should he attempt to gain entry.

Brian Simpson, chief executive of Wirral Partnership Homes, said: "We will not tolerate criminal behaviour in our tenancies and will continue to monitor this tenant's behaviour, together with that of anyone living at or visiting her home, very closely."

Caroline Laing, manager of Wirral's anti-social behaviour team, said: "Pratt has been given a last chance to conduct her tenancy in a way that her landlord and other residents expect."

The eviction order remains in force until January 12, 2012. If breached, Pratt faces eviction from her home.
